Now What?
It’s a common thing …you’ve found your “little piece of heaven” here at Lake Alan Henry and you’re ready to grab your skid steer and “rip out” all the trees and brush on your land so you can get rolling with your plans to build the “home of your dreams” … Well, you must remember that you are now a part of a Homeowners Association which has a few Restrictive Covenants that must be followed – but we are here to help!
We’ve put together this list of “Frequently Asked Questions” to help our members navigate the “Restrictive Covenants” of our Homeowners Association.
Frequently Asked Questions
FAQ#1. Can I operate a business inside the gate at Oak Canyon Estates?
Answer: No. Lots located inside the HOA gate are for residential purposes only. So, you cannot use your property as an Air BNB, or as a rental property. [See Item #1 in the Restrictive Covenants] * Please Note: Lots 95 through 101 (Outside the HOA Gate) are considered Commercial Lots and can operate a business under certain conditions [See Item #2 in Restrictive Covenants]
FAQ#2. Can I store my old vehicles or equipment in Oak Canyon Estates?
Answer: Generally, you CANNOT store any vehicles, boats, equipment, etc. except in a garage or other structure approved by the Architectural Control Committee. This includes skid steers, tractors and the accessories needed to operate them. No RV’s or Travel Trailers can be stored outside at any time. [See Item #4 in the Restrictive Covenants] * Please Note: in 2021 the Architect Committee ruled that you can have a utility trailer or boat on your property if the license and registration are kept current, and the tires are inflated. Such trailers/boats should be parked neatly at the back of the property and, whenever possible - hidden from view.
FAQ#3. Do I have to control the grass and weeds on my lot at Oak Canyon Estates?
Answer: Yes – You need to keep your lot, driveways and the landscaping on your home in a neat and attractive condition. If you fail to control the grass and weeds on your lot – the HOA may elect to clean up your lot - at your expense. [See Item #29 in the Restrictive Covenants]
FAQ#4. Can I take my skid steer and clear all of the brush and trees from my property in Oak Canyon Estates?
Answer: According to our Restrictive Covenants - You cannot totally clear your lot of trees and brush if such action shall have the effect of degrading the environment or character of the Subject Tract. [See Item #3 in the Restrictive Covenants].
Important: You are responsible for obtaining all necessary storm water runoff permits, and any other permits required by the Texas Commission on Environmental Water Quality (TCEQ) [See last paragraph (Item #7) in the Restrictive Covenants – Contact Information for the TCEQ Office is located on the bottom of this page]
Also: Before you begin any clearing operations, you must contact the Architectural Control Committee to ensure that your plans do not adversely affect existing surface drainage patterns that will cause erosion. [See Item #13 in the Restrictive Covenants].
Should you be given permission to clear a portion of your lot, you must haul off any brush and tree limbs you remove. You may take the Trees/Brush (only) you have removed to the HOA Designated Area for disposal. This disposal area is provided free of charge to our members – Please contact John Mason for access to this area.
No burning of trash, brush, rubbish or other debris shall be permitted at any time, under any circumstances. No rubbish, trash or construction debris may be deposited or disposed of anywhere within the Subdivision. [See Item #5 in the Restrictive Covenants]
FAQ#5. Can I bring my RV or Travel Trailer and park it on my lot?
Answer: This is the MOST ASKED question! The general answer is No… You can ONLY have an RV or Travel Trailer on your property if:
(1) You are actively building a home, AND You have an approved permit IN WRITING from the Architectural Control Committee – AND you MUST install your septic system before you can place any approved RV Trailer on your lot. [See Item #16 in the Restrictive Covenants].
(2) If you have an established home, you may allow guests to park their RV or Travel Trailer on your lot for 7 consecutive days before it must be removed. [See Item #4 in the Restrictive Covenants]
* Please Note: There is absolutely NO (day/night) camping in tents - or overnight Travel Trailer use - allowed in Oak Canyon Estates on undeveloped lots (see item #2 above). The Architect Control Committee is the only entity that can authorize RV or Travel Trailer use at Oak Canyon Estates.
FAQ#6. Can I hunt game or shoot my guns inside Oak Canyon Estates?
Answer: Absolutely No hunting is allowed, and Firearms may not be discharged within the development. [See Item #22 in the Restrictive Covenants]
FAQ#7. What procedure is required to build a home in Oak Canyon Estates?
Answer: First - you need to have a Certified Architect draw your plans. No makeshift, or “napkin” drawings will be allowed. Drawings must be complete and include - Electrical, Plumbing, and HVAC drawings. You must also include the color scheme of all exterior walls & the color of your roof. You will also need to provide a site plan showing the exact location of where your building(s) will be located on your property.
Second - as a courtesy (ONLY) You may elect to contact the HOA President and he will guide you through the steps to get your plans submitted to the Architectural Control Committee for approval. Once approved (in writing) by the ACC, you are free to build your project. [See Item #9 in the Restrictive Covenants]
Third – Upon approval of your plans – once you begin construction - ALL CONSTRUCTION must be completed within 12 months -. [See Item #7 in the Restrictive Covenants]
You will be billed $50 per our By-laws for the ACC review of your plans. (See Section 9.04 in our By-Laws). * Please Note: The Architectural Control Committee is the sole authority as to what type of construction is allowed here in Oak Canyon Estates. The ACC can rule on anything not specifically enumerated in our Restrictive Covenants.
FAQ#8. When I start building my approved home – what do I need to do?
Answer: You must place on site, a means to haul off all construction debris (roll-off or dumpster), And a portable toilet to be in use during the duration of your project - for your workers. [See Items #5 and #16 in the Restrictive Covenants]
FAQ#9. Are there restrictions as to the type and size of house I can build in Oak Canyon Estates?
Answer: Yes – Please see the following Restrictive Covenants:
Item #6 – Minimum Size of Residence Item #7 – Type of Construction
Item #8 – Roof Construction [Also See Item #5 and #9 in the Restrictive Covenants]
* Please Note: It is important to ensure that a permanent driveway (concrete or similar) is not constructed on the 10’ Utility Easement because, if a water line breaks, the Water Company will need to remove a portion of the driveway to repair the lines.
FAQ#10. Can I have a Gas or Butane Tank in Oak Canyon Estates?
Answer: ONLY if the tank can be architecturally hidden from view… [See Item #28 in the Restrictive Covenants] * Please Note: in 2021 the Architect Committee ruled that you can have a Gas/Butane Tank if you keep it painted and maintained, and if you are able to place some sort of architectural barrier – (short fence or similar structure/shrubbery) in front of the tank to partially obstruct it from being visible from the road. Contact the Architectural Control Committee if you have questions about tank placement.
FAQ#11. Can I build a swimming pool on my lot in Oak Canyon Estates?
Answer: Yes – The Architectural Control Committee must approve the construction of any swimming pool built in Oak Canyon Estates. – and all pools must be “in-ground” only… [See Item #15 in the Restrictive Covenants] *Please Note: Water usage may be restricted by Rio Brazos Water System during drought conditions.
FAQ#12. Can I drill a water well on my property in Oak Canyon Estates?
Answer: Yes! – Please see the Restrictive Covenants concerning the size of the pump allowed, and restrictions on location of the well. (The well cannot be located less than 150’ from your septic tank – to prevent ground water contamination). [See Item #14 in the Restrictive Covenants]
FAQ#13. Can I build a tall fence around my property in Oak Canyon Estates?
Answer: The City of Lubbock requires that all fences at Lake Alan Henry be constructed with a certain height restriction and to where wildlife migration is not impeded. The Architect Control Committee must be contacted BEFORE erecting any fence. The fence cannot be built past the 300’ Set Back Easement. [See Item #9 in the Restrictive Covenants]
FAQ#14. Can I bulldoze a path to the water and build whatever I want down at the lake?
Answer: NO! – This is an ordinance with the City of Lubbock, and you could face serious consequences for violating this ordinance. There is a process available to Lot Owners to gain access to the waterfront, but you must get your plans approved by the City of Lubbock prior to any work being performed within 300’ of the lakeshore.
